• The Artist retains all rights to the work. Works commissioned may not be used for commercial purposes.
• The Artist retains ALL the rights to the commissioned artwork, including the right to make prints and merchandise, and to alter the commissioned work to make it more generic for print at the Artist’s discretion.
• The Client may not use commissioned works to mint NFTs or train AI or any other similar activites.
• The Artist retains the right to display all commissioned work on any personal website, gallery, or journal.
• The Client retains all rights to their respective characters. This does not allow them rights to the commissioned image
• The Client may not profit from the artwork beyond the resale of a physical original painting or drawing (traditional media, not digital). This includes the sale of the digital files, or rights to the image
• The Artist retains the right to decline any commission for any reason. The Artist reserves the right to cancel a commission and issue a refund due to poor communication, rude or inappropriate behavior, or inability to communicate in clear/effective English, or unforeseen inability to complete the commission.
• The Client may repost watermarked versions provided with proper credit given to personal online galleries such as Toyhou.se, DeviantArt, and FurAffinity.
• The Artist's works may not be edited without explicit permission.
• When ordering, be as clear and concise as possible with visual references and/or description. Errors made from poor communication on the Client's end are not the Artist's fault and subject to an editing fee to fix.
• The Client will have the opportunity to direct alterations of the work at the sketch/thumbnail stage and at the flat colour stage. Requested revisions that diverge from the Client's original commission description/references may increase the length of time a commissions takes, and will be billed separately. Minor revisions can be made after the commission is complete.
• The Artist will not draw NSFW/Mature/Erotic/18+ art for minors. I will blacklist minors who attempt.
• The Artist does not work under deadlines and the time which commissions are completed varies greatly.
• The Artist may recycle sketches and preparatory works that were rejected by the Commissioner for other commissions or personal works.
• Breaking of these ToS will result in the commission being canceled, the commissioner being blacklisted from ordering from me in the future, and all payments made kept by The Artist.
• ToS is binding to all commissioned works, past and future.

Payment

• All prices are in USD and payment completed through Paypal. Alternate payment means may be discussed privately.
• The Artist requires full payment upfront before any work will begin. Payment plans my be discussed for orders over $100.
• All orders are subject to complexity fees.
• Edits after significant progress in the work are subject to extra fees.
• Refund policy is as follows; if the client wishes to cancel their commission before work begins, the artist will retain 10% of the original commission payment in US dollars as a convenience fee. In the event of Client cancellation during the sketch/thumbnail stage phase, a 50% refund of original payment will be issued. No refund will be issued if the Client cancels during the color stage, or after the commission is complete. If the Artist cancels the commission, 100% of the original commission payment in US dollars will be refunded to the Client.

Designs

• All designs and artworks of said designs, pre-made or commissioned, are bound by the Artist's full Terms of Service.
• The Client is free to edit the designs.
• The Artist's works may not be edited without explicit permission.
• Closed Species are beholden to their species terms of service. If the Closed Species terms do not allow design changes, the Client is not allowed to edit the design.
• The client may not claim credit for the original design.
• Any design marked as resellable is able to be resold at any price as long as the following applies:
• The design has extra artwork and not just the Artist's base design. All designs sold on Toyhou.se have prices listed in the transaction history. Designs sold on other sites will have final sales price in the post description.
• The seller is not purposely price gouging or flipping.
• The Artist holds the right to place price caps on designs made by The Artist, or designs under the Artist's IP (such as Closed Species), at any time.
• Closed Species are beholden to their species terms of service. Some have unique sales rules, which are to be followed if different from the Artist's.

The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms.
